THE ACTIVE CIRCLE

The Active Circle is strictly for individuals aged 18 or over.

Children under 18 must not:

• Create accounts

• Browse or use the Platform

• Communicate with users

• Book or attend events

This applies without exception.

Children must never attend events listed on the Platform, even if supervised.

The Active Circle does not provide safeguarding, DBS-checked Hosts, or child-specific GDPR compliance.

Users must confirm they are 18+ at registration.

False age declaration is a material breach. We may immediately suspend or delete accounts suspected to involve minors and delete associated data in line with UK GDPR.

Members acknowledge that:

• Attendance is voluntary

• They assess suitability themselves

• Participation is entirely at their own risk

The Active Circle provides no medical or fitness advice.

Members confirm they are medically fit and will seek professional advice where appropriate.

Members are responsible for:

• Their own equipment

• Following Host instructions

• Monitoring environmental and physical conditions

The Active Circle is not responsible for equipment failure or misuse.

Reviews reflect personal opinion only and are not verified or endorsed.

The Active Circle provides an online marketplace that enables Members to discover, book and pay for activities hosted by independent Hosts.

Payments are facilitated through Stripe. The Active Circle collects payments on behalf of Hosts solely for the purpose of processing bookings and facilitating payouts.

The Active Circle is not a party to the agreement between the Host and the Member and is not responsible for the quality, safety, legality or delivery of any activity listed on the Platform.

All payments made through the Platform are securely processed by our trusted payment service provider Stripe.

The Active Circle does not store your full payment card details.

By using the Platform, you acknowledge and agree that payments are processed by Stripe and are subject to Stripe's applicable terms and conditions.

The Active Circle is not responsible for payment delays, processing errors, banking issues, chargebacks, account restrictions, payment disputes or service interruptions caused by Stripe or any financial institution.

Hosts may list activities on The Active Circle without paying any listing fees.

Hosts set their own activity prices and receive 100% of the advertised activity price. No Platform Service Fee or Stripe payment processing fee is deducted from the Host's advertised activity price.

Members agree to pay:

• The activity price set by the Host;

• A Platform Service Fee of 3% charged by The Active Circle; and

• Stripe's payment processing fee (currently 1.5% + £0.20 per transaction, or such rate as may be amended by Stripe from time to time).

These fees are added to the activity price during checkout and are clearly itemised before payment is confirmed.

By completing a booking, the Member agrees to pay the total amount displayed at checkout.

There are no hidden charges.

No Platform Service Fee or Stripe payment processing fee applies to activities offered free of charge.

To receive payouts, Hosts must maintain a valid Stripe account and provide any information reasonably required by Stripe for identity verification, regulatory compliance and payment processing.

Where applicable, Hosts may also be required to provide a valid payment method for subscriptions or other paid services offered by The Active Circle.

Payment details are stored securely by Stripe and are never stored by The Active Circle.

Providing payment details does not result in an immediate charge unless you expressly authorise a payment or subscribe to a paid service.

Unless the Host has specified a different cancellation policy on the activity listing:

• More than 48 hours before the activity: Full refund of the activity price.

• Between 24 and 48 hours before the activity: Partial refund, where applicable.

• Less than 24 hours before the activity: No refund.

Unless required by applicable law, the Platform Service Fee and Stripe payment processing fee are non-refundable once payment has been successfully processed.

Members who fail to attend an activity without cancelling in accordance with the applicable cancellation policy are not entitled to a refund. This is clearly marked as absent by the host at the end of the activity.

If a Host cancels an activity, Members will receive a full refund of the entire amount paid, including the activity price, the Platform Service Fee and any Stripe payment processing fees, in accordance with applicable consumer law.

The Active Circle is not responsible for reimbursing travel expenses, accommodation costs, loss of earnings or any indirect or consequential losses resulting from a cancelled activity.

The Active Circle reserves the right to amend its Platform Service Fee and/or reflect changes to Stripe's payment processing fees.

Any changes will be communicated on the Platform before they take effect and will apply only to future bookings.

Hosts are independent third parties, not employees or agents of The Active Circle.

Hosts are solely responsible for:

• Accuracy and legality of listings

• Event safety and delivery

• Compliance with all laws

• Licences, permissions, and insurance

• Participant suitability

Hosts must not allow children to attend events under any circumstances.

Hosts agree to indemnify and hold harmless The Active Circle against all claims arising from:

• Their events

• Injuries or losses

• Legal or regulatory breaches

• Negligence or misrepresentation
